Terms of Use

Definitions

When used herein the following terms shall have the following meaning:

1. “Any applicable laws” shall refer to the laws of the United Kingdom, in addition to any laws which may be applicable in any other jurisdiction where the Client may be based or resident.

2. “Associated Firm” means any entity with whom “Traders Harmony” has a marketing agreement with, including any other Clients and Service Providers.

3. “Agent” means the Independent Marketing Agent.

4. “Client Services Agreement” means the agreement entered into between “Traders Harmony” and any associated firm or its Customers, including the Customers defined in this section.

5. “Client” means any person, body or entity who is an actual or potential client of “Traders Harmony” and its Service Providers.

6. “Effective Date” shall mean the date first set forth above. This agreement shall become effective on the date written above unless another date shall be mutually agreed upon in writing.

“Service Provider” means any counterparty(ies), we refer to the client to acquire required services for the client.

Acceptance of Terms

1. These Terms of Use ("Terms") govern your use of the services provided by Traders Harmony ("the Company"), and all associated companies, including but not limited to our website, applications, and any other related services (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. If you do not agree to these Terms, you may not use the Service.

Use of the Service

1. You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

2. You agree to use the Service only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

3. You agree that you may need to verify your identity, contact number, email address, and another related document we may require to provide you the service.

4. You agree that we may need to share some or all the information provided by you with the required counterparty to provide you with our services.

5. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Intellectual Property Rights

1. The Service and its original content, features, and functionality are owned by Traders Harmony, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

2. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as necessary to use the Service for its intended purpose.

Privacy Policy

1. Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Service, you consent to the terms of our Privacy Policy.

Limitation of Liability

1. In no event shall Traders Harmony, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

   1. your access to or use of or inability to access or use the Service;

   2. any conduct or content of any third party on the Service;

   3. any content obtained from the Service; and

   4. unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Indemnification

1. You agree to indemnify and hold Traders Harmony and its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys' fees) arising from or in any way related to your use of the Service or violation of these Terms.

Governing Law

1. These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Changes to Terms

1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, it will replace the previous terms with new terms without any notice. What constitutes a material change will be determined at our sole discretion.
